Alternative Dispute Resolution

Alternative Dispute Resolution
August 18 – August 23, 2008; Washington, D.C.

This seminar familiarizes participants with alternative methods of dispute resolution (ADR). The first part of the seminar approaches mediation and conflict management as a way of avoiding or resolving litigation and of addressing relationships in business with employees, customers and suppliers. It is conducted primarily through simulations and employs a neurolinguistics approach to understanding and improving communications among parties who may not be relating well. The seminar also draws insights from game theory in order to analyze strategic behavior in business and professional relationships.

The second part of the seminar examines the legal issues and processes involved in international arbitration and the arbitral process. Significant attention is also given to the unique processes and procedures characteristic of arbitration in the United States (for example, according to the American Arbitration Association rules). Creative alternatives to mediation and arbitration will also be explored. A visit to the International Centre for the Settlement of Investment Disputes (ICSID) at the World Bank is also planned.

The entire seminar emphasizes the development of practical skills. The program will be led by experienced and respected mediators, arbitrators and law professors, including Professor John Baker from Louisiana State University Law School, Donald Green (AAA Arbitrator, Counsel at Pepper Hamilton, Adj. Professor at Georgetown University Law Center), Jean Baker (District Vice President, American Arbitration Association [AAA]), Professor John Crook from George Washington University Law School, and Andrea Saldarriaga, an international arbitration specialist formerly with Freshfields (Paris).

Tuition for the "Alternative Dispute Resolution" program is $1,550. Housing arrangements range from $400 - $700 for the period of the program (check-in August 17, check-out August 23.) Persons also participating in the "U.S. Legal Methods: Introduction to U.S. Law" program (July 21 - August 15, 2008) will receive a $400 discount on the tuition for "Alternative Dispute Resolution."
